A. Cancellation Policy

Introduction

Consumers have a right of withdrawal according to the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity:

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.

To exercise your right of withdrawal, you must inform us (ACS Group GmbH, Otto-Hahn-Str. 38a, 85521 Ottobrunn (Riemerling), Germany, Tel.: +49 (0)89 1893130-0, Fax: +49 (0)89 1893130-30, E-Mail: tabletklasse@acsgroup.de) by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) about your decision to withdraw from this contract. You can use the attached model withdrawal form for this purpose, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the notification of exercising the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (except for the additional costs arising from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), immediately and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund. We may refuse the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.

You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the nature, properties and functioning of the goods.

Exclusion or Early Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for whose manufacture an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

The right of withdrawal expires prematurely for contracts for the delivery of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery.

Connected/Financed Transactions

If you finance this contract with a loan and later withdraw from it, you are also no longer bound to the loan contract, provided that both contracts form an economic unit. This is particularly assumed if we are your lender at the same time or if your lender uses our cooperation with regard to the financing. If the loan has already been received by us when the withdrawal becomes effective or when the goods are returned, your lender shall enter into our rights and obligations from the financed contract in relation to you with regard to the legal consequences of the withdrawal or return. The latter does not apply if this contract relates to the acquisition of financial instruments (e.g. securities, foreign exchange or derivatives). If you want to avoid a contractual commitment as far as possible, make use of your right of withdrawal and also withdraw from the loan contract if you also have a right of withdrawal for this.

General Notes

1) Please avoid damage and contamination of the goods. Please return the goods to us in the original packaging with all accessories and with all packaging components. Use a protective outer packaging if necessary. If you no longer have the original packaging, please ensure adequate protection against transport damage with suitable packaging.
2) Please do not return the goods to us postage due.
3) Please note that the above points 1-2 are not a prerequisite for the effective exercise of the right of withdrawal.
